Terms

General Terms and Conditions, including promotional items:

1. Price, availability, and terms are subject to change without notice. All price, availability, and purchases are subject to additional review, modification, rejection and/or approval by Lisa Hoffman Beauty.

2. LH Skin Care LLC reserves the right, at any time, to verify the validity of orders, sample requests and claimants (including a claimant's identity, age and place of residence) and to disqualify any claimant who submits a request that is not in accordance with these Terms and Conditions or who tampers with the Offer process. Failure by LH Skin Care LLC to enforce any of its rights at any stage does not constitute a waiver of those rights.

3. Incomplete, indecipherable, illegible, late, early, lost, misdirected, or undelivered orders or requests will be deemed invalid and are void.

4. Only one (1) Sample request/claim permitted per person, household, order, e-mail address or mailing address.

5. LH Skin Care LLC screens all received orders for fraud or other types of unauthorized or illegal activity. We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If such is the case, we may reject your order or our Customer Service department may call you at the phone number you provided to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses due to suspected fraud or unauthorized or illegal activity. We take these measures to protect our customers as well as ourselves from fraud or other unauthorized or illegal activity.

6. If a Promotional Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of LH Skin Care LLC, LH Skin Care LLC reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify applicable Sample claimants; and/or (b) to modify, suspend, terminate or cancel the Offer, as appropriate.

7. Any cost associated with accessing a Promotional Offer website is the claimant's responsibility and is dependent on the Internet service provider used. LH Skin Care LLC makes no guarantee of the availability of the Offer website and its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Offer.

8. Except for any liability that cannot be excluded by applicable law, LH Skin Care LLC, its affiliates, and their respective shareholders, owners, members, directors, managers, officers, employees, agents and contractors exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotional Offer, including, but not limited to, where arising out of the following:

(a) any technical difficulties or equipment malfunction (whether or not under LH Skin Care LLC’s control);
(b) any theft, unauthorized access or third party interference;
(c) any Sample claim,/request, required Offer documentation or information, or Sample that is late, lost, altered, damaged, incomplete, indecipherable, illegible, late, lost, undelivered or misdirected (whether or not after their receipt by LH Skin Care LLC) due to any reason beyond the reasonable control of LH Skin Care LLC;
(d) any tax liability incurred by a claimant/consumer; and/or
(e) use of the Sample.

9. LH Skin Care LLC collects personal information in order to process orders or to conduct Promotional Offers and may, for an indefinite period, unless otherwise advised by LH Skin Care LLC, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning claimants/customers and such other purposes outlined in the privacy policy at www.lisahoffmanskincare.com/privacypolicy.html. Customers/claimants should direct any request to access, update or correct information to LH Skin Care LLC. All Sample claims/requests become the property LH Skin Care LLC.

10. Promotions may be subject to additional Terms and Conditions (see below).

Race to Erase $35 Gift Card

1. The entire $35 amount must be used at time of purchase. Any remaining balance is not applicable toward future purchases.

2. Coupon code can only be redeemed once; (1) order per person, household, e-mail address or mailing address.

3. No cash redemption.

Madagascar Orchid & Japanese Agarwood Sample Offer

1. No purchase necessary. While supplies last. Void where prohibited, taxed or restricted.

2. Participation in the Madagascar Orchid & Japanese Agarwood Free Sample Offer (the “Offer”) is deemed acceptance of these Terms and Conditions. The Offer is not valid in conjunction with any other promotional offer of LH Skin Care LLC. Any other use constitutes fraud.

3. How to Claim Madagascar Orchid & Japanese Agarwood. Only those individuals who received the email offer from LH Skincare, LLC on 4/25/09 are eligible to receive a sample of Madagascar Orchid and Japanese Agarwood (the “Sample”) and will automatically be sent the Sample by mail. Offer Commences on 4/25/09 and closes 4/30/09 (“Offer Period”). Sample claims/requests must be received by LH Skin Care LLC prior to the close of the Offer Period. Only 15,000 liqua-touch samples available.

4. The Offer is only open to United States residents aged 18 years or over. Employees, agents and contractors of LH Skin Care LLC and its affiliates, and retailers of LH Skin Care LLC products are ineligible to participate in the Offer.

5. Customers/claimants should allow at least 28 days from the date of their request form, to receive their Sample. All decisions of LH Skin Care LLC regarding this Offer are final and no correspondence or other communications will be entered into. In the event of unavailability of the quantity of Samples specified herein, LH Skin Care LLC reserves the right, in its sole discretion, to substitute the Sample for another sample product of equivalent value and/or specification while supplies last (and subject to the total quantity of Samples specified herein).
